These Terms of Service ("Terms") govern your access to and use of the Tribe mobile application, websites, and related services (collectively, "Tribe").

Tribe is operated by Intelligence81 Pty Ltd ("Intelligence81", "we", "us", or "our").

By creating a Tribe account, selecting Accept, or otherwise using Tribe after being shown these Terms, you agree to be bound by these Terms. If you do not agree, do not create an account or use features that require acceptance.

These Terms apply in addition to any property-specific documents, rental application terms, residential tenancy agreement, building rules, payment terms, or other agreement that may apply to a particular property or service.

Important: Tribe is a technology and resident-experience platform. These Terms are not a residential tenancy agreement and do not replace any tenancy agreement or rights you may have under applicable law.

1.Who may use Tribe

You must be at least 18 years old, or otherwise legally capable of entering into the relevant agreements, to create an account or submit a rental application through Tribe.

By using Tribe, you represent that:

  • information you provide is accurate and not misleading;
  • you have authority to provide information and documents submitted through your account;
  • you will keep your account credentials secure; and
  • you will comply with applicable laws and these Terms.

You may browse certain public features without an account where Tribe allows it.

2.Your Tribe account

You may need to create an account to use personalised or resident features.

You are responsible for:

  • maintaining the confidentiality of your login credentials and verification codes;
  • activities carried out through your account;
  • keeping your contact information current; and
  • notifying us promptly if you suspect unauthorised access.

Do not share passwords, one-time passcodes, or security credentials with another person.

We may require you to re-authenticate or verify your identity before allowing access to sensitive account, application, payment, or resident functionality.

3.Tribe Passport

Tribe Passport is a profile that may help you store and reuse information relevant to your Tribe journey, including:

  • contact details;
  • preferred locations;
  • home preferences;
  • budget and move-in preferences;
  • lifestyle preferences;
  • rental application information; and
  • other information you choose or are required to provide.

Tribe Passport is intended to reduce unnecessary repetition. It does not guarantee that information in your Passport will be sufficient for every property or application.

You are responsible for keeping information in your Tribe Passport accurate and up to date.

4.Sara, AI features, and recommendations

Tribe may provide AI-assisted features, including Sara, Tribe's AI concierge.

Sara may help you:

  • search for homes;
  • understand property or neighbourhood information;
  • identify preferences from natural-language conversations;
  • receive personalised recommendations;
  • navigate Tribe functionality; and
  • find relevant resident or support information.

AI-generated content may occasionally be incomplete, outdated, or inaccurate. You should confirm important information relating to:

  • property availability;
  • rent and fees;
  • application requirements;
  • legal obligations;
  • tenancy terms;
  • payments;
  • safety;
  • eligibility; and
  • contractual commitments

using the official information displayed by Tribe, the relevant property team, landlord, agent, or applicable documents.

A recommendation from Sara is not a guarantee of property availability, suitability, approval, or tenancy.

Unless clearly stated otherwise, Sara does not make binding legal, financial, tenancy, or property-management decisions.

5.Property listings and availability

Tribe may display information about homes, properties, amenities, neighbourhoods, and availability.

We aim to keep this information current, but:

  • availability may change;
  • prices and inclusions may change before a binding agreement is entered into;
  • photographs may show a particular apartment, display apartment, building area, or representative styling;
  • furnishings, views, layouts, amenities, opening hours, and services may vary; and
  • third-party information may change without notice.

Where information conflicts with a signed residential tenancy agreement or legally required disclosure, the signed agreement or applicable legal document will prevail to the extent permitted by law.

6.Rental applications

Tribe may allow you to submit or manage a rental application.

An application may require information such as:

  • identity details;
  • employment or income information;
  • affordability information;
  • rental history;
  • references;
  • supporting documents;
  • consent to verification; and
  • other information reasonably required for the tenancy assessment.

Submitting an application does not guarantee approval, an offer, or availability of a property.

The landlord, property manager, agent, or other authorised property provider may be responsible for the final decision on a tenancy application.

Tribe may facilitate collection, verification, organisation, or transmission of application information, but is not necessarily the decision-maker for the tenancy.

Where a property provider uses a tenancy database, credit check, reference check, affordability assessment, or other assessment, additional disclosures or consents may apply.

7.Identity and verification

Certain features may require identity, document, fraud-prevention, or liveness verification.

Verification may be carried out by Tribe or an approved third-party verification provider.

Before biometric information is collected for automated biometric verification or identification, Tribe will provide a relevant notice and, where required, seek specific consent.

Please review the separate Tribe Verification Policy before completing verification.

Verification does not itself guarantee approval for a home, account, payment, or other service.

8.Residential tenancies

If you enter into a residential tenancy, the tenancy is governed by the residential tenancy agreement and applicable law.

For properties in New South Wales, additional rights and obligations may arise under NSW residential tenancy laws.

Tribe does not replace:

  • the residential tenancy agreement;
  • the tenant information statement;
  • condition reports;
  • strata by-laws;
  • bond requirements or Rental Bonds Online processes; or
  • other documents that a landlord or agent must provide.

You should read all tenancy documents carefully before signing.

9.Payments

Tribe may facilitate payments relating to rent, deposits, bonds, amenities, orders, or other services.

Payment processing may be provided by third-party payment providers.

Where a third-party payment provider is used:

  • its terms and privacy practices may apply;
  • Tribe may receive transaction status, reference, amount, or other payment-related information; and
  • card or bank credentials may be processed directly by the payment provider.

You are responsible for ensuring payment information you provide is accurate and that you have authority to use the selected payment method.

Do not treat a payment as successful until Tribe or the relevant provider confirms its status.

Property-specific payment obligations remain governed by the tenancy agreement and applicable law.

10.Neighbourhood, merchants, and partner content

Tribe may display neighbourhood information, local businesses, retail offers, dining, services, events, rewards, sponsored content, or partner promotions.

Third-party business information may include:

  • opening hours;
  • pricing;
  • product availability;
  • walking distance;
  • pickup timing;
  • offers; and
  • reward information.

This information may change without notice.

Where you purchase from or interact with a third-party merchant, the merchant may be responsible for the goods or services it supplies, and its own terms may apply.

Sponsored or partner content will be identified where required.

11.Tribe Coins, rewards, and membership benefits

Where Tribe offers reward points, Tribe Coins, membership tiers, discounts, or benefits, additional reward terms may apply.

Unless expressly stated otherwise:

  • rewards are not cash;
  • rewards are not a bank deposit or financial product;
  • rewards may only be used in the ways described by Tribe;
  • earning and redemption rules may vary;
  • rewards may be subject to expiry, limits, reversals, or eligibility conditions; and
  • Tribe may correct rewards credited in error.

Any material change affecting accrued benefits will be handled in accordance with applicable law.

12.Amenities, access, and resident services

Residents may receive access to amenities, building access features, parcel services, events, bookings, visitor services, or other resident functionality.

Property-specific rules apply.

You must use these services:

  • safely;
  • lawfully;
  • in accordance with building rules;
  • without interfering with other residents; and
  • only for authorised purposes.

Access credentials, digital keys, QR codes, or similar credentials must not be shared except where the feature expressly permits it.

13.Property team messaging and communications

Tribe may allow you to communicate with a property team, support team, merchant, or other authorised participant.

Do not use Tribe communications to:

  • threaten, harass, abuse, or discriminate;
  • send unlawful or fraudulent content;
  • impersonate another person;
  • send malware or harmful code;
  • publish another person's private information without authority; or
  • make emergency reports where a dedicated emergency channel should be used.

Tribe messaging is not an emergency service.

For immediate threats to life or safety, contact the appropriate emergency service. For urgent property matters, use the emergency or after-hours contact process supplied by your property team.

14.User content

You may upload or submit information, images, documents, messages, feedback, and other content ("User Content").

You retain ownership of your User Content.

You grant us a non-exclusive licence to host, store, reproduce, process, transmit, and display User Content only as reasonably necessary to:

  • provide Tribe;
  • process applications;
  • provide resident services;
  • support you;
  • meet legal or security obligations; and
  • operate features you request.

You must have the right to submit User Content.

15.Acceptable use

You must not:

  • use Tribe for unlawful or fraudulent purposes;
  • attempt to gain unauthorised access to Tribe, another account, or connected systems;
  • interfere with the security or operation of Tribe;
  • scrape or systematically extract content except where permitted by law or written agreement;
  • reverse engineer the app except to the extent such restriction is prohibited by law;
  • bypass security, identity, or access controls;
  • submit false or forged documents;
  • misuse another person's identity;
  • abuse promotions or rewards; or
  • use Tribe in a way that materially harms another person or our systems.

We may investigate suspected misuse and take proportionate action.

16.Third-party services

Tribe may integrate third-party services such as:

  • identity verification;
  • payments;
  • maps;
  • communications;
  • analytics;
  • cloud infrastructure;
  • authentication; and
  • AI services.

Your use of third-party functionality may also be subject to the provider's applicable terms and privacy notices.

We are not responsible for third-party services to the extent permitted by law, but nothing in these Terms excludes rights that cannot lawfully be excluded.

17.Intellectual property

Tribe, including its software, design, branding, text, graphics, interfaces, and other content supplied by us, is owned by or licensed to Intelligence81 Pty Ltd and is protected by applicable intellectual property laws.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use Tribe for its intended purpose.

You may not copy, distribute, sell, sublicense, modify, or commercially exploit Tribe except as permitted by law or with our written permission.

Third-party trademarks, images, and content remain the property of their respective owners.

18.Availability and changes to Tribe

We may update Tribe to:

  • add or remove functionality;
  • improve security;
  • comply with law;
  • address technical issues; or
  • improve the user experience.

We do not guarantee that every feature will always be available, uninterrupted, or supported on every device.

Where a change materially affects an existing paid entitlement or legal right, we will handle the change in accordance with applicable law.

19.Suspension and termination

We may suspend or restrict access where reasonably necessary because of:

  • suspected fraud;
  • security risk;
  • unlawful activity;
  • serious or repeated breach of these Terms;
  • risk to another user or property;
  • legal or regulatory requirements; or
  • misuse of Tribe.

Where appropriate, we will provide notice and an opportunity to address the issue.

You may stop using Tribe at any time.

Account deletion is available through the app where required.

Termination of a Tribe account does not automatically terminate a residential tenancy or remove obligations under another agreement.

20.Privacy

Our handling of personal information is described in the Tribe Privacy Policy.

Identity and biometric verification is further described in the Tribe Verification Policy.

These documents should be read together with any collection notice shown when particular information is requested.

21.Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded, including rights that may apply under the Australian Consumer Law.

To the maximum extent permitted by law, any limitations or exclusions in these Terms operate only to the extent they are lawful.

22.Disclaimers

To the extent permitted by law:

  • Tribe is provided on an "as available" basis;
  • we do not guarantee that all third-party information is error-free or continuously current;
  • recommendations are informational and personalised guidance, not guarantees;
  • neighbourhood information is not a substitute for your own assessment of an area; and
  • property availability is subject to change until a binding agreement is entered into.

Nothing in this section limits a right that cannot legally be excluded.

23.Liability

To the maximum extent permitted by law, Intelligence81 is not liable for indirect, incidental, special, or consequential loss arising solely from use of Tribe where such liability can lawfully be excluded.

This limitation does not apply to:

  • rights or remedies that cannot legally be excluded;
  • liability that cannot lawfully be limited; or
  • loss caused by fraud, wilful misconduct, or other conduct for which exclusion is prohibited by law.

24.Changes to these Terms

We may update these Terms from time to time.

If a change materially affects your rights or obligations, we will take reasonable steps to notify you before or when the updated Terms take effect, as required by law.

The latest version will show the effective date at the top.

25.Governing law

These Terms are governed by the laws applicable in New South Wales, Australia, subject to any mandatory laws that apply based on your location or circumstances.

Nothing in this clause prevents you from exercising a right to bring a claim in another forum where applicable law gives you that right.

26.Apple App Store users

If you downloaded Tribe from Apple's App Store:

  1. these Terms are between you and Intelligence81 Pty Ltd, not Apple;
  2. Intelligence81, not Apple, is responsible for Tribe and its content;
  3. your licence to use Tribe on Apple-branded products is non-transferable and subject to applicable Apple usage rules;
  4. Apple has no obligation to provide maintenance or support for Tribe;
  5. to the maximum extent permitted by law, Intelligence81 is responsible for claims relating to Tribe, including applicable product, consumer, privacy, or regulatory claims;
  6. Intelligence81 is responsible for investigating and addressing any claim that Tribe infringes third-party intellectual property rights;
  7. you must comply with applicable third-party terms when using Tribe;
  8. Apple and its subsidiaries are third-party beneficiaries of the applicable licence terms and may enforce those terms against you; and
  9. you represent that you are not prohibited from receiving or using the app under applicable trade or sanctions laws.

If Apple provides a refund or remedy under its own applicable terms, those terms will also apply.
